2. Hosting and server log files
This website is hosted by goneo Internet GmbH, Dresdener Straße 18, 32423 Minden, Germany. When you access the website, the hosting provider automatically processes, on my behalf, information transmitted by your browser (server log files): IP address, date and time of access, page or file requested, volume of data transferred, status of the request, browser type and version, operating system and the referring URL.
This processing serves to deliver the website, to ensure its technical security and stability and to defend against attacks. The legal basis is Article 6(1)(f) GDPR (legitimate interest in secure and uninterrupted operation). Log files are retained by the hosting provider only for as long as necessary for these purposes and are then deleted automatically. A data processing agreement under Article 28 GDPR is in place with the hosting provider.
3. No cookies, no analytics, no third-party content
This website sets no cookies, uses no analytics or tracking tools and embeds no third-party content (such as external fonts, maps, videos or social-media elements). No data is transferred to third parties other than the hosting provider.
4. Contact by e-mail or telephone
If you contact me by e-mail or telephone, I process the data you provide (in particular your name, contact details and the content of your enquiry) in order to handle the enquiry and any follow-up questions.
The legal basis is Article 6(1)(b) GDPR where the enquiry is aimed at concluding or performing an engagement; otherwise Article 6(1)(f) GDPR (legitimate interest in responding to enquiries). I delete enquiries that do not lead to an engagement once the matter has been finally answered, unless statutory retention obligations apply. If an engagement is concluded, the data is processed in the client file and retained in accordance with Section 50 BRAO and the retention periods under German tax and commercial law.
Please note that unencrypted e-mail is not a confidential means of transmission. As a Rechtsanwalt I am bound by professional secrecy (Section 43a(2) BRAO, Section 2 BORA). For confidential content I will agree an encrypted channel on request.
5. Recipients
Recipients of personal data are the hosting provider (processor) and – in the event of an engagement – the bodies necessary for handling the matter (such as courts, authorities, opposing parties and service providers engaged subject to the professional-secrecy safeguards of Section 43e BRAO). The operation of this website does not involve any transfer to third countries outside the EU/EEA.
6. Your rights
You have the right to access (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18) and data portability (Article 20), as well as the right to object, on grounds relating to your particular situation, to processing based on Article 6(1)(f) GDPR (Article 21). These rights are subject to statutory limitations, in particular the professional secrecy of Rechtsanwälte (Section 29(1) sentence 2 BDSG).
You also have the right to lodge a complaint with a supervisory authority (Article 77 GDPR). The authority competent for the controller is the State Commissioner for Data Protection and Access to Information of Brandenburg (Die Landesbeauftragte für den Datenschutz und für das Recht auf Akteneinsicht Brandenburg), Stahnsdorfer Damm 77, 14532 Kleinmachnow, Germany, www.lda.brandenburg.de.
7. Obligation to provide data
You are under no statutory or contractual obligation to provide your data. However, I cannot answer an enquiry without the information required to handle it. No automated decision-making, including profiling (Article 22 GDPR), takes place.
